Terms of Service
These Terms of Service ("Terms") govern the use of the website (thevos.jp, the "Site") operated by THEVOS ECO Laboratory Co., Ltd. (株式会社THEVOS ECO研究所, the "Company") and the services and solutions provided by the Company (the "Services"), as agreed between the Company and the user.
1. Definitions
"Services" means website production, web hosting, email, domain registration and management, AI solutions (including the AI consultation bot "ai.Hanes"), and any other services and solutions the Company provides on the Site. "User" means any individual or entity that uses the Site or the Services; "Member" means a User who has registered in accordance with the Company's procedures.
2. Application and Amendment
These Terms apply to the User's use of the Services. The Company may amend these Terms upon prior notice to Users when it deems necessary, and the amended Terms take effect when posted on the Site.
3. Formation of Contract
A service contract is formed when the User agrees to these Terms, registers or applies for a Service, and the Company accepts.
4. Provision of Services
The Company provides the Services. The content, specifications and fees of each Service are as posted on the Site, and the Company may change them upon prior notice. The Company may temporarily suspend all or part of the Services due to maintenance, failures or force majeure.
5. Fees and Payment
The User shall pay the fees set out on the Site by credit card (PAY.jp) or bank transfer. Monthly services are billed automatically on the monthly billing date; annual services (such as domains) are billed automatically on the renewal date. Details of fees and billing timing are set out in the "Legal Notice under the Specified Commercial Transactions Act".
6. Cancellation and Refunds
Cancellation can be made at any time from "Service Management" in My Page. If cancellation is completed by the day before the next billing date, no further charges will occur. Due to the nature of the Services, returns, refunds or pro-rata refunds after payment are not accepted in principle. See the "Refund & Cancellation Policy" and the "Legal Notice" for details.
7. User Obligations and Prohibited Acts
Users must not engage in acts that violate laws or public order, infringe the rights or interests of the Company or third parties, interfere with the operation of the Services, or register false information.
Our AI services run publicly available AI models on servers we operate ourselves. The use restrictions set by the provider of those models apply, and accordingly you must not use our AI services or their outputs to do any of the following.
- Generate content that infringes the intellectual property or other rights of any third party
- Generate content that promotes or facilitates child sexual exploitation, illegal drugs, violent extremism or any other crime
- Use them for fraud, phishing, spam, malware or any other deceptive or unlawful purpose
- Generate content that promotes discrimination, hatred, harassment, bullying or self-harm, or that otherwise harms others
- Identify or track an individual without their consent, or handle sensitive personal data without proper authority
- Give legal, medical, accounting, financial or other regulated advice without holding the required qualification
- Present AI-generated content as human-authored, or impersonate another person in a way that misleads
- Generate content whose main purpose is sexual expression (other than for academic, educational, journalistic or artistic purposes)
- Attempt to circumvent safety measures
If you allow a third party to use our AI services, you must impose equivalent restrictions on that third party. If this clause is breached, we may suspend the AI features without prior notice.
8. Intellectual Property
Copyrights, trademarks and other intellectual property rights relating to the Site and the Services belong to the Company or the rightful holders. "VosCMS", "RezlyX", "NaitoWork X" and "ai.Hanes" are brands and trademarks of the Company.
9. Disclaimer
The Company is not liable for interruption or suspension of the Services due to natural disasters, communication line failures or other force majeure. The Company does not warrant the completeness, accuracy or usefulness of information provided through the Services.
10. Personal Information
The Company handles Users' personal information appropriately in accordance with its separately established "Privacy Policy".
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute between the Company and the User relating to the Services shall be subject to the exclusive jurisdiction of the Fukuoka District Court (福岡地方裁判所) as the court of first instance.
